    4 Roseville police officers sued for excessive force

    When the driver fled Hernandez stayed put for the next several minutes. But when the officer came back Hernandez started to exit the vehicle and you then hear on that video the officer say; "He's starting to get out, hey, don't you move!" Within seconds Hernandez was taken down to the ground by that officer and that officer then began using his Taser on Hernandez while yelling at him to put his hands behind his back.

    What is in question is if Hernandez was resisting arrest. Hernandez's lawyer said he wasn't, and that he doesn't understand or speak much English. "I don't think he understood what the order was because of the language barrier," attorney Paul Edlund said. Edlund said Hernandez was complying as best he could with what he understood but, Edlund claims, it didn't matter.

    In a lawsuit filed Wednesday Edlund is alleging excessive force and false arrest against the four Roseville officers who were on the scene early that morning. In the dash cam video, while Hernandez was down with two officers on top and next to him, two more arrive. One of them delivers a kick and a punch to Hernandez.

    In his official police report the officer shown Tasing Hernandez said: "Fearing he may be trying to retrieve a concealed weapon I deployed my Taser into his right side." Hernandez did not have a weapon on him.

    When Hernandez was brought back to his feet it is also audible on the dash cam video that one of the officers was mocking him in Spanish. Moments after you see a second dash cam video showing Hernandez thrown into the back of the squad car head first.

    The lawsuit against the four officers is alleging excessive force and false arrest of Hernandez. Damages of at least 500,000 dollars are being sought.

    Also noteworthy is that the charges trumped up to justify the beating and arrest of Victor Yair Hernandez-Rivera were dismissed earlier this year. They had no case.
